Terms of Service
Please read these Terms of Service carefully before using Jambona. By creating an account or using the platform you agree to be bound by these Terms. If you do not agree, do not use Jambona.

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and the Commission of African Society, Business, Art & Culture, a body under the Pan African Dialogue Institute (PADI) ("we", "us", "our"), governing your access to and use of the Jambona platform, website, and related services (collectively, the "Service").
By registering an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy, which is incorporated herein by reference.
2. Eligibility
To use Jambona, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding agreement in your jurisdiction.
- Not have been previously suspended or permanently banned from the platform.
- Not be located in a country subject to a government embargo that would prohibit your use of the Service.
By using Jambona you represent and warrant that you meet all of these requirements.
3. Account Registration and Security
When you create an account, you agree to:
- Provide accurate, current, and complete information.
- Keep your account information up to date.
- Keep your password confidential and not share it with any third party.
- Notify us immediately at [email protected] if you suspect any unauthorised access to your account.
- Be solely responsible for all activity that occurs under your account.
You may only create one account. Creating multiple accounts to circumvent a suspension or for other deceptive purposes is prohibited.
4. User Content
4.1 Ownership
You retain full ownership of all content you create, upload, or submit to Jambona ("User Content"), including publications, profile information, photos, and event listings.
4.2 Licence to Jambona
By submitting User Content to the platform, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, display, reproduce, and distribute your content solely for the purpose of operating and improving the Jambona Service. This licence ends when you delete the content or close your account, subject to reasonable backup retention periods.
We do not claim ownership of your work and will not use your content in advertising or for commercial purposes beyond operating the platform without your explicit consent.
4.3 Your responsibility
You are solely responsible for your User Content. By submitting content, you represent and warrant that:
- You own the content or have all necessary rights and permissions to post it.
- Your content does not infringe the intellectual property, privacy, or other rights of any third party.
- Your content complies with all applicable laws and these Terms.
5. Acceptable Use
You agree to use Jambona only for lawful purposes and in a manner that respects other users and the integrity of the platform. You must not:
- Use the platform to harass, threaten, abuse, or intimidate any person.
- Impersonate any person or organisation, or misrepresent your affiliation with any entity.
- Use automated tools, bots, scrapers, or scripts to access or extract data from the platform without our written consent.
- Attempt to gain unauthorised access to any part of the Service, its servers, or related systems.
- Introduce viruses, malware, or any other harmful code.
- Use the Service to send unsolicited bulk communications (spam).
- Circumvent, disable, or interfere with any security features of the platform.
- Use the platform for any illegal activity or to facilitate illegal acts.
6. Prohibited Content
The following content is strictly prohibited on Jambona:
- Content that is hateful, discriminatory, or incites violence against any person or group based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other characteristic.
- Content that sexualises minors in any way.
- Content that constitutes defamation, libel, or malicious falsehood.
- Graphic or gratuitous violence.
- Content that infringes copyright, trademarks, or other intellectual property rights.
- Personal data of others shared without their consent.
- Misinformation presented as factual that could cause public harm.
- Political propaganda or coordinated inauthentic behaviour.
We reserve the right to remove any content that violates these Terms without prior notice and to suspend or terminate the account of the user who posted it.
7. Intellectual Property
All elements of the Jambona platform — including the name, logo, visual design, code, and original content produced by us — are owned by the Commission of African Society, Business, Art & Culture / Pan African Dialogue Institute and protected by applicable intellectual property law.
Nothing in these Terms grants you a right to use our trademarks, logos, or other brand elements without our prior written consent.
8. Third-Party Services
Jambona integrates with third-party services including Google (authentication) and Supabase (infrastructure). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.
Links to external websites or resources on Jambona are provided for convenience only. We do not endorse and are not responsible for the content, products, or services available from third-party sites.
9. Privacy
Your use of Jambona is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. We do not warrant the accuracy or completeness of any content on the platform, including User Content posted by other members.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the Commission of African Society, Business, Art & Culture and the Pan African Dialogue Institute shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service.
Our total cumulative liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Jambona, the Commission of African Society, Business, Art & Culture, the Pan African Dialogue Institute, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
13. Termination
Termination by you
You may close your account at any time via Settings → Account → Delete Account. This will remove your personal data in accordance with our Privacy Policy.
Termination by us
We reserve the right to suspend or permanently terminate your access to the Service, with or without notice, if we determine in our sole discretion that you have violated these Terms, applicable law, or that your continued use poses a risk to other users or the platform.
Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, liability limitations, and indemnification — shall survive.
14. Governing Law and Dispute Resolution
These Terms are governed by internationally recognised principles of contract and data protection law. Given Jambona's pan-African scope and global user base, we aim to resolve all disputes fairly and in accordance with applicable local law.
We encourage users to first contact us at [email protected] to resolve any dispute informally. If an informal resolution is not possible within 60 days, disputes shall be submitted to binding arbitration under internationally recognised arbitration rules.
Nothing in this clause limits your right to seek urgent injunctive relief from a court of competent jurisdiction, or to make a complaint to a data protection supervisory authority.
EU / UK users: If you are a consumer resident in the EU or UK, you retain the right to bring proceedings before the courts of your country of residence and to benefit from mandatory consumer protection provisions applicable in your jurisdiction, regardless of any other provision of these Terms.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and/or by a prominent notice on the platform at least 14 days before the new Terms take effect.
Your continued use of Jambona after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service before the effective date.
